Terms of Service

These Terms of Service (the "Terms") form a binding agreement between you and Craft Solution Tech FZE-LLC, the company that operates Formiqa (the "Service", "we", "us"). By creating an account or using the Service, you agree to be bound by these Terms.

If you are using Formiqa on behalf of an organization, you confirm that you have authority to bind that organization, and "you" in these Terms refers to that organization.

You must provide accurate and complete information when creating an account, and keep that information up to date. You are responsible for safeguarding your password and for any activity carried out under your account. Notify us immediately if you believe your account has been compromised.

You must be at least 16 years old to create an account.

Formiqa offers a free plan and one or more paid plans. Paid plans are billed monthly in advance through our payment processor, Stripe. By upgrading to a paid plan, you authorize us to charge your payment method on a recurring basis until you cancel.

You can cancel a paid plan at any time from your account settings. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial months, except where required by law.

We may change pricing for paid plans. We will give you at least 30 days' notice of any price increase that affects you, by email.

You agree not to use the Service to:

• collect, transmit, or store any content that is unlawful, defamatory, infringing, hateful, or that violates the privacy rights of others,
• engage in phishing, scams, or any deceptive practice with respect to respondents,
• send unsolicited mass communications using the Service's notification features,
• attempt to gain unauthorized access to the Service, other accounts, or our infrastructure,
• reverse-engineer, copy, or resell the Service,
• upload malware or otherwise interfere with the Service's operation.

We may suspend or terminate accounts that violate this section.

You retain ownership of all content you submit to or create on Formiqa, including the forms you build and the submissions you collect ("Your Content").

You grant us a limited, worldwide, non-exclusive license to host, store, transmit, and display Your Content solely as necessary to provide the Service. We do not use Your Content for any other purpose, and we never use form submissions to train AI models.

You are solely responsible for Your Content, including ensuring that you have the necessary rights and consents to collect and process the data you collect through your forms. You act as the data controller for the personal data of your respondents; we act as a data processor.

The Service, including its software, design, brand, and documentation, is owned by Formiqa and is protected by intellectual property laws. These Terms grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for its intended purpose. No other rights are granted.

You may close your account at any time from your account settings. When you close your account, we delete your account data and Your Content within 30 days, except where retention is required by law.

We may suspend or terminate your access to the Service if you breach these Terms, if your use poses a security or legal risk to us or other users, or if your account is inactive for an extended period. Where reasonably possible, we will provide notice and an opportunity to remedy the issue.

The Service is provided on an "as is" and "as available" basis. While we take reasonable steps to keep the Service running reliably, we do not warrant that the Service will be uninterrupted, error-free, or that any data loss will not occur.

To the fullest extent permitted by law, we disclaim all warranties not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, our total aggregate liability arising out of or related to the Service is limited to the greater of (a) the amount you paid us in the twelve months preceding the event giving rise to the claim, or (b) one hundred (100) euros.

We are not liable for any indirect, incidental, consequential, or punitive damages, including loss of profits, loss of data, or business interruption.

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and notify you by email or in-app notice. Your continued use of the Service after a change takes effect constitutes your acceptance of the revised Terms.

These Terms are governed by the federal laws of the United Arab Emirates and the applicable laws of the Emirate of Sharjah, without regard to conflict-of-law principles. Craft Solution Tech FZE-LLC operates under the regulations of the Sharjah Publishing City Free Zone (SPCFZ).

Any dispute arising out of or in connection with these Terms will be submitted to the exclusive jurisdiction of the competent courts of Sharjah, United Arab Emirates, except where mandatory consumer protection laws of your country of residence provide otherwise.
